Child Seat Rules in Taxis, Rideshare and Hire Cars — Queensland and NSW
The short answer
In Queensland, a child restraint is not required in a taxi, limousine or ride booking vehicle. A baby under one may legally be held on the lap of someone aged 16 or over, and a child from one to under seven may travel in an adult seatbelt. That is the law, not a loophole an operator is exploiting.
In New South Wales, it depends on what you booked. A taxi has a partial exemption. A hire car or a rideshare has none at all, the same rules that apply in your own car apply in theirs, and the driver wears the fine and the demerit points if a child is not properly restrained.
So the same family, on the same day, travelling from the Gold Coast to Byron Bay, passes from a state where nothing is required into a state where a restraint is compulsory for a booked hire vehicle. We carry the seats and fit them free either way, in both states, on every transfer.
What Queensland actually says
Queensland's standard rule is the national one: a child up to seven years old must be secured in a properly fastened and adjusted restraint that meets the Australian Standard, whenever the vehicle is moving or stopped in traffic.
Then comes the exemption. Restraints are not required on buses, trains, or personalised transport services, the category that covers taxis, limousines and ride booking. Inside that exemption:
- A child under one year may be held on the lap of a passenger aged 16 or older.
- A child one year to under seven may be restrained by a seatbelt.
- A child may not sit in the front row if the vehicle has two or more rows of seats.
- The exemption does not extend to rental cars you drive yourself.
- If a restraint is already fitted in the vehicle, the driver is responsible for making sure the child is properly secured in it.

What New South Wales actually says
New South Wales splits point to point transport into categories that are treated differently, which is where most of the confusion comes from.
Taxis have a partial exemption. A child under one must be in a suitable, properly fastened approved restraint, for a baby up to six months that means rear facing. A child over one may travel in the back in a properly fastened seatbelt, and a taxi is not permitted to refuse the hiring on that basis.
Hire cars and rideshare have no exemption. The rules are the ordinary private vehicle rules. A rideshare driver who takes an unrestrained toddler is personally liable, which is why a driver may simply decline the trip when a family arrives without a seat.
In all three, children are not permitted in the front seat. Point to point vehicles built after 1993 are required to have child restraint anchorage points, and you may always bring and use your own approved restraint.

What the standard means
An approved restraint carries AS/NZS 1754, the joint Australian and New Zealand standard. A seat bought overseas, including from the United States or the United Kingdom, does not meet it and is not legal to use here, however good it is. Every seat we carry is AS/NZS 1754 approved.

Ages are a guide. Height and weight decide the right seat, and the markings on the seat itself are what matter. Tell us your children's ages and rough weights when you book and the correct seats are fitted and checked before the driver leaves to collect you.

The reason is simple: the exemption describes what is permitted, not what is safe. A lap is not a restraint at 100 km/h on the M1.
Questions parents actually ask
Q: Is it legal for my toddler to ride in a taxi in Queensland without a car seat?
A: Yes. A child from one to under seven may use an adult seatbelt in a taxi, limousine or ride booking vehicle in Queensland, and a child under one may be held on a lap. Legal and safe are different questions.
Q: Will an Uber take my baby without a capsule?
A: In New South Wales a rideshare has no exemption, so the driver is legally required to have the child properly restrained and may refuse the trip. In Queensland ride booking sits inside the exemption. Either way, rideshare drivers do not generally carry capsules.
Q: Do you charge for child seats?
A: No. Not for one, not for four, not in any vehicle.
Q: Can I bring my own seat?
A: Yes, in both states. Tell us at booking and the driver will help fit it, or leave the anchor point free for you.
